The preliminary hearing for singer D4vd, whose legal name is David Anthony Burke, started this week in Los Angeles County Superior Court.
Burke, 21, faces first-degree murder charges with special circumstances in the death of 14-year-old Celeste Rivas Hernandez. He has also been charged with lewd acts with a minor and unlawful mutilation of human remains. Burke has pleaded not guilty, and his attorneys deny the allegations.
The hearing, expected to run several days, will determine whether prosecutors have shown enough evidence for the case to move forward to trial. A judge does not decide guilt at this stage, only whether probable cause exists.
What Prosecutors Allege
According to court filings, Burke and Rivas Hernandez met online and were involved in a relationship that began when she was 13. Prosecutors say she threatened to expose the relationship and damage his music career just as tickets for his tour were about to go on sale.
On April 23, 2025, prosecutors allege Burke arranged a ride to bring Rivas Hernandez to his home in the Hollywood Hills. That was the last confirmed contact anyone had with her.
Investigators say she was killed that night, and that in the days that followed, Burke purchased items including chainsaws, a body bag, heavy-duty laundry bags and an inflatable pool, which prosecutors believe were used to conceal and dispose of her remains.
Her body was discovered five months later, in September 2025, inside a Tesla registered to Burke after the car had been towed and residents nearby noticed a smell.
Legal Proceedings Ahead
Former federal prosecutor Neama Rahmani said the burden of proof at this stage is comparatively low, requiring only probable cause, and he expects several LAPD detectives to testify about the evidence gathered during the investigation. He described the case against Burke as strong.
Separately, Burke’s attorney has asked the court to allow him to appear without handcuffs during the hearing, arguing he has not been disruptive in prior court appearances. As of this week, the judge overseeing the case had not ruled on that request.
Prosecutors have not announced whether they will pursue the death penalty. If convicted, Burke could face life in prison without parole.
